If we see the history H1B and GC numbers were never increased except 2004 20k inpast 15 years In 2000 it was increasd temporarlily for 4 years.Also EB numbers were never increased except temporary reliefs.If it is increased by Skill bill in current form that is really an acheivement. If there is a possiblity they may increase H1B because that is temorary visa(But in reallity not) and GC numbers may remain same. But if increased to 115k then also cap will be reached in another 1 month because there are more number of Desi companies than number of H1Bs. Thats why they are asking exemptions for MS people and 20% adjustment for every year. We have to wait and see whether congress fall on this trap to do this without analysing the impact.

I think your interpretation of this situation makes sense. I would like to add that the jumbs and increased activity in the uscis/dos etc all happened in anticipation of the CIR passing through and becoming law to be effective in the next FY. They probably wanted to clear of as many legal applicants/backlogs as possible before the next rush based on point system. I agree with you that this is not a conspiracy but more a miscommunication. Whatever the case, hopefully, the AILF litigation will bring some order to the system.

I do understand that our biggest goal is to reduce backlog. With due respect to your opinion, i suggest that we restrict to july fiasco first and then when we get enough traction with this issue, we can then focus on larger issues like backlog reduction etc.
Now that each one of us breathing hot and cold about july error, we better trade on that line.

People wont be able to come tommorow so this must be done July 14th or July 21. Also, the rally should not be about just the July bulletin. It should be about backlogs and numerical caps as the root cause of this mess.
But do get city permit for around 100 people (that's what I expect will show up in Bay area based on past experience with Gutierrez rally).
Let's get some attention from CEOs of Oracle, Cisco, Sun and Google and also some attention from Rep. Zoe Lofgren and Nancy Pelosi. There couldnt be a better place than Bay area to do this, especially San Jose.

Everyone getting receipt notices, and not coming to the rally, (not coming to the rally -most on tracker threads), please at least consider contributing to the rally once you get your notice or FP done or get EAD!. The rally cost is huge and we can do much more if people can contribute generously.

I did and I got a response in mail saying there are extremely high volume of cases filed before me, that is why it is taking time.
Did you try Ombudsman route? It may take a few more weeks, I guess it is worth a try.

I may sound some what negative here but I am not trying to diminish the IV plat form for all the folks here.Yes, it is just "about us" only... what "IV core" did so far is vague....flower campaign and this current FOIA requests started randomly by the individuals thinking collectively.... I agree. Something strong needs to happen for EB3(I). I personally never have seen any difference between the pain felt by EB2 and EB3, ROW or I. Everyone feels the same pain waiting for their GC. But the prospect for EB2 atleast looks better. For EB3 it looks gloomy as always.
If there is a lawsuit, then it should be for all, not just for EB3.

As per law one should have intent to work full-time for the employer (or AC-21 employer) at the time of approval. There is no time period specified.
The intent, of course, can change after some time. Lawyers differs on the duration. Some argue it is 90 days, whereas others suggest 180 days or 1 year.

There may be a problem when you want to apply for U.S. citizenship later, if you leave the sponsoring employer in a short period of time after obtaining the Green Card.
The AC-21 rule does not clear the issue of a person who leaves its employer after the I-485 approval, but it is better to take a conservative way to reduce the potential risk later.

Whatever bluesky1 said is true...finally they opened our box. Today I called and rep gave me only I-485 receipt number and told me to wait for mail. USCIS likes everyone to wait for every thing......I have no more information but as soon as I get mail I will post all the info.
3rd july people should call now and I am definite we all were sitting in same box.
What a painful 100 days it was..................hopefully everything is correct on receipt...wait again and see.....

I understand we want to stand alone with our issues and that may be favourable to us from an anti-immi stance taken by many in Govt and otherwise. I am not sure though if by alienating EB retrogression issue with H1B increase we will be able to get anything done.
Our main supporters are teh corporations who hire us and want us to be perm. There bigger concern right now is getting more people who can hired on H1B. Unless we threaten mass exodus, I do not think we stand a chance if we try to run alone with only EB retrogression issue.
People (Senators aginst CIR or SKILL and even NUmbers USA) may say that OK we are not against you folks, but the point is will those same people do something about our predicament if this was the only thing on the table, I dont think so.

Try to call the service center directly, e.g. call at a time when the service center is open. The 1-800 number will transfer you automatically and you should hear something like "welcome to NSC/TSC, etc...". If the service center is closed and they transfer you to the national customer service something you can hang up because they're useless. All they know is to open SRs which get routed to the thrash bin.
I did exactly as in the post above, except for the part where I tell them I'm "depressed" (they probably figured I was anyway :)) and I got my FP notice three days later. I got a soft LUD right after the call, which is a good indication that the IO actually did something. If you don't get an LUD call again the next day, and the next day,..... eventually you'll run into someone who can help.
